Rulings Differ Over GlaxoSmithKline’s Corporate Citizenship
Since the U.S. Supreme Court established the "nerve center" test as the definitive test for determining corporate citizenship, two Eastern District of Pennsylvania federal judges have issued conflicting rulings on whether GlaxoSmithKline is a corporate citizen of Pennsylvania or Delaware. One judge ruled two Brooklyn plaintiffs should not have their case removed from the Philadelphia Commons Pleas Court because GSK operations were primarily conducted in that city, while a second judge ruled that Delaware was where significant decisions were made.
